Well it was bound to happen. I got a call from the Public Defender and they want to interview me along with the prosecution. No trial is set yet, but I am a witness so I'm very likely going to be taking the stand.

Are they pressing charges or simply deciding if they should? It sounded like it wasn't going to trial at your last posting on account of the guy's mental condition and people saying it was out of character.

The county prosecutor decided to press assault charges, hence my continuing involvement.

I hope things go okay for you with that situation...
And I really hope the girl is okay; do you know if she suffered any lasting damage from being hit in the head like that?
Also strikes me as odd that here it is more than two months later and things are still being decided in the courts - I know that's how the court system works, but... my god, that's a long time to have to deal with this kind of aftermath... can't be easy for the girl he hurt.

Ok. Talked to the attorney. He just wanted to touch base and such, asking me what I saw during the incident. I told him the same thing I told the cops. Apparently the pre-trial hearing is tomorrow and they're not sure if it'll be a plea bargain or a full-on trial yet.

Will you need to actually show up in court to give your statement in person? Or are they using your statement in other ways without you having to go in person?

So far, I won't have to go to court. From how the defense attorney sounded, his client is pretty much toast. That said, if it goes to trial and I'm still in the area, I'll probably be called in to testify.

Considering the beating his fiancee took and that my statement proves he attacked her during an argument? Yeah, he's clearly guilty. Yes, he had psychological issues exacerbated by bad meds, but the fact is he still attacked her. I hope for some lenience, but he needs to know what he did was beyond unacceptable. Of course I hope the doc who fucked up the meds gets theirs too.

If he was even a little in his mind to understand right and wrong some kind of punishment is in order. I'm not saying harsh harsh punish the poor and ill as an example but something.
